Terms of Service

These Terms of Service (the "Terms") govern your access to and use of MYKO — an adaptive mathematics diagnostic and practice platform — together with its related websites, applications, and services (collectively, the "Service"), operated by Myko Education Centre Pte Ltd, a company incorporated in Singapore ("MYKO", "we", "us", or "our").

By creating an account, ticking the acceptance box at sign-up, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You may use the Service only if you can form a binding contract with us and are not barred from doing so under any applicable law.

The Service is intended for students of secondary-school mathematics and may be used by minors. If you are under the age of 18 (or the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service. We may require verifiable parental or guardian consent where the law demands it. If you do not meet these requirements, do not use the Service.

You are responsible for ensuring that anyone you allow to use your account meets these requirements.

2. Your account

You must provide accurate information when you register and keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Accounts are personal to you and may not be shared, sold, or transferred. Notify us promptly at support@mykoeducation.com if you suspect unauthorised use of your account.

3. Subscriptions, free trial, and billing

The Service is offered on a paid subscription basis, with pricing that may vary by region and is shown to you before you subscribe.

4. Cancellation and refunds

Free trial. If your subscription includes a free trial, you will not be charged provided you cancel before the trial ends. If you do not cancel, the subscription converts to a paid subscription at the end of the trial and the applicable fee is charged.

Cancelling. You may cancel at any time from your account settings or by contacting support@mykoeducation.com. Cancelling stops future renewals. Your subscription stays active until the end of the billing period you have already paid for, and then does not renew.

Refunds. Subscription fees are charged in advance and are generally non-refundable. We do not provide refunds or credits for partial billing periods, or for time you did not use the Service. This does not affect any rights you have under Singapore law that cannot be excluded (see clause 17).

When we will refund. We will refund a charge where: (a) you were charged in error or charged more than once for the same period; (b) a billing error on our part caused an incorrect charge; or (c) a refund is required under applicable law. At our discretion, we may also offer a refund or account credit as a goodwill gesture — for example, where a verified technical fault on our side prevented you from using the Service for a significant period. Granting a discretionary refund once does not oblige us to do so again.

How to request. To request a refund, contact support@mykoeducation.com within 14 days of the charge, quoting your account email and the charge details. Approved refunds are returned to your original payment method; the time to appear depends on your payment provider.

5. The Service, and AI-generated feedback

The Service uses automated systems, including artificial-intelligence models, to read photographs of your handwritten working, mark it, generate hints and explanations, and recommend practice.

"Your Content" means the photographs of your working, answers, and other material you submit to the Service.

You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, analyse, and create derived data from Your Content for the purposes of operating, providing, securing, and improving the Service. This licence includes processing Your Content through trusted third-party service providers, including AI model providers, acting on our behalf.

We may create and retain de-identified and aggregated information derived from Your Content, and use it to develop and improve the Service and our models. Such information does not identify you.

You represent and warrant that you have all rights necessary to submit Your Content and to grant the licence above, and that Your Content does not infringe the rights of any third party or violate any law. Do not submit content that is unlawful, infringing, or that contains other people's personal information without their consent.

The Service, including its software, question banks, skill maps, explanations, text, graphics, and design, and all intellectual-property rights in them, are owned by us or our licensors. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial study. No other rights are granted. "MYKO" and our logos are our trademarks and may not be used without our prior written consent.

9. Third-party services

The Service relies on third-party services, including payment processing and AI model providers. Your use of those services may be subject to their own terms, and we are not responsible for them. We are not liable for the acts or omissions of third-party providers.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that information will be processed as described there, including processing of student work through third-party AI providers. Where you are a parent or guardian consenting on behalf of a minor, you consent to that processing on the minor's behalf.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any feedback or content will be accurate or reliable.

12. Limitation of liability

To the maximum extent permitted by law:

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold us and our officers, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

14. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, if we are required to do so by law, or to protect the Service or other users. You may stop using the Service and cancel your subscription at any time. On termination, the licences granted to you end; provisions that by their nature should survive (including content licence for already-processed content, intellectual property, disclaimers, limitation of liability, indemnification, and governing law) survive.

15. Changes to the Service and these Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you and, where appropriate, ask you to accept the updated Terms. Changes take effect when posted or on the date we specify. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

16. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of Singapore, without regard to conflict-of-laws rules, and you submit to the exclusive jurisdiction of the courts of Singapore, except where applicable law gives you the right to bring proceedings elsewhere.

17. Your statutory rights

Some jurisdictions provide consumers with guarantees and rights that cannot be excluded, restricted, or modified. Nothing in these Terms excludes, restricts, or modifies any such non-excludable rights, and where these Terms would otherwise do so, they apply only to the extent permitted by law.

18. General

These Terms are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
